Pub faces £1,000 bill for waste offence

Debbie Shalom, manager of The Bedford Tavern in Western Street, Hove has been fined £450 and ordered to pay £550 costs after failing to make proper arrangements to dispose of trade waste from the business.
 
Shalom appeared at  Brighton magistrates' court and admitted failing to produce a duty of care waste transfer note for the business, an offence under the 1990 Environmental Protection Act.
 
The prosecution was brought by Brighton & Hove City Council which was contacted by residents in Western Street. The residents were concerned about the amount of rubbish and bottles from the pub being deposited in two communal bins in the street which are intended for use by people living in the street.
 
The court was told that Ms Shalom was given three weeks to produce a trade waste agreement, but did not respond to letters from the council. She was then given a fixed penalty fine of £300 and, when this was not paid, the matter was taken to court. The £450 fine imposed by the court now replaces the original £300 fine).
 
Cllr  Geoffrey Theobald, the council's Cabinet member for Environment said:
"We are very pleased with the verdict and that magistrates are imposing tough penalties on those businesses which fail to make proper arrangements for removal and disposal of their trade waste.
 
"Most businesses act responsibly and pay sizeable amounts to have their waste removed - it is not fair that a small minority should flout the law in this way."
 
All businesses have a legal duty to show their trade waste is dispose of and they do this by producing their duty of care waste transfer note.
